Privacy: Subject: Guidelines on handling personal data, in accordance with Article 13 of Legislative Decree 196/2003, covering the code concerning the protection of personal data, and request for your permission to handle said data. 1. Legislative Decree 196/2003 introduced the code governing the protection of personal data. In compliance with the points stipulated by this code, the handling of personal data by our organisation follows principles of fairness, lawfulness and transparency, as well as safeguarding the confidentiality and the rights of the parties to which the data refers. 2. Within this framework, we wish to provide you the guidelines stipulated in Article 13 of Legislative Decree 196/2003 and ask you to provide your permission to handle the personal data listed below for the following purposes: a. to handle your request for information and/or bookings with an end to supplying you relevant information 3. In order to meet the requirements stated above, it is necessary for you to provide your personal information; failure to provide this, whether wholly or in part, may result in it being impossible to provide you the requested services. 4. Permission for data handling and the purposes as at point 4 is not obbligatory; as a result of any denial, your data shall only be handled for the purposes indicated at previous point 2. 5.Where clients or potential clients are concerned, the data handled is generally of a common nature, as it essentially consists of elements of personal identification. In the event that you should indicate data in fields not requiring any specific provision of data which, in line with Article 4 letter d) of Legislative Decree 196/2003, is of a sensitive nature, and as this type of data requires particular protection measures, we would inform you that this data will be handled by ourselves within the limits stipulated by the Privacy Code. We would remind you that generally speaking, Article 4 letter d) of Legislative Decree 196/2003 defines as “sensitive data" all that personal data which “is apt to reveal the ratial or ethnic origin, faiths of religious, philosophical or other nature, political opinions, membership to parties, trade unions, associations or organisations of a religious, philosophical, political or trade union nature, as well as any personal data that might reveal state of health and sex life”. 6. The data gathered shall be handled using paper and/or electronic instruments, and in any case in compliance with the relevant regulatory provisions in force. 7. We would state that our organisation carries out the necessary organisational, physical and logical measures needed to guarantee the safety of data, with particular reference to the points stipulated in Annex B of Presidential Decree 196/2003– Technical specifications concerning minimum safety measures. 8. In addition to the Company's employees, some of your personal data may be handled by third parties, based in Italy and/or abroad, to which our organisation entrusts said activities (or part thereof) which are needed to supply the above services. In this case, the subjects themselves shall operate in their capacity as autonomous Owners or shall be appointed as Managers or Heads of data handling. Any Managers and Heads of handling appointed will receive suitable operating instructions, with particular reference to adopting the minimum safety measures. This shall guarantee the confidentiality and safety of data. The above mentioned third parties are essentially included within the following categories: Debt recovery companies, companies which elaborate traffic data for invoicing, companies appointed to handle press and sending of invoices to clients, consultancy companies, Credit brokers, Agents and Brokers, Franchisees, Technological service providers and Content Providers. 9. To follow is an extract of Article 7 of Legislative Decree 196/2003, to remind you that you can exercise the following rights where we are concerned: a. to obtain confirmation of the existence of personal data concerning you, even if not yet recorded, and for this to be communicated in an intelligible form b. to obtain an indication as to the origin of the personal data, as well as the purposes and method of the handling c. to obtain an indication as to the logic applied in data handled using electronic instruments d. to obtain an indication as to the identifying details of the owner and the managers e. to obtain an indication as to the parties or categories of parties to whom the personal data may be communicated, or who may become aware of them in their capacity of State representative, or manager or head of handling f. to obtain the updating, rectification or, where it is in your interests, the addition of data g. to obtain the cancellation, transformation into anonymous form or the blockage of data handled in violation of the laws in force h. to obtain the cancellation, transformation into anonymous form or the blockage of data not needing to be kept for the purposes for which it was gathered or subsequently handled i. to obtain a statement that the updating, rectification, addition, cancellation, transformation into anonymous form or blockage has been brought to the attention, including with regard to the content, of those individuals to whom the data was communicated or diffused, excepting in cases where this should prove impossible or where it involves the use of means which are manifestly disproportionate to the right being protected j. to oppose yourself, whether wholly or in part, for legitimate reasons, to the handling of personal data concerning you, even if it is relevant to the purposes of the data gathering k. to oppose yourself, whether wholly or in part, to the handling or personal data concerning you for the purposes of sending advertising or direct sales material, or for carrying out market research or sales communications. 10.
